Terms of Service

1. Scope of Services

Bluejaypro is a digital marketing and search engine optimization (SEO) agency specializing in Local SEO, Organic SEO, AI SEO & GEO Optimization, Technical Audits, Content Creation, Link Building, and Google Business Profile management for businesses (including dental practices, HVAC contractors, law firms, home theater installers, and local service providers).

• Website Visitors & Free Tool Users: We provide informational content, interactive SEO Cost Calculators, and web-based AI SEO tools on an “as-is” basis.
• Agency Clients: Specific SEO deliverables, timelines, retainers, and pricing for ongoing agency clients are governed by these Terms alongside your signed Master Services Agreement (“MSA”), Proposal, or Statement of Work (“SOW”). In the event of a direct conflict between these Terms and a signed SOW, the signed SOW shall control.

2. No Guarantee of Specific Search Rankings

While Bluejaypro utilizes data-driven, white-hat, and industry-proven SEO strategies designed to grow your organic visibility, local map pack presence, traffic, and leads, you acknowledge and agree that:

1. Search engines (such as Google and Bing) and AI answer engines (such as ChatGPT, Gemini, and Perplexity) are controlled by independent third parties that frequently update their proprietary algorithms without notice.
2. Bluejaypro cannot and does not guarantee specific #1 rankings, exact search positions, or specific volumes of traffic, leads, or revenue within a fixed timeframe.
3. Estimates generated by our online SEO Cost Calculators or Google Review Calculators are for informational and planning purposes only and do not constitute a binding quote or performance guarantee.

3. Use of Interactive Calculators & AI SEO Tools

Bluejaypro provides specialized calculators and AI SEO utilities across bluejaypro.com and its subdomains. When using these tools, you agree not to:

• Use automated scripts, bots, or scrapers to overload, reverse-engineer, or extract proprietary logic from our calculators or tools.
• Upload malicious files, malware, or unauthorized third-party data into our log analyzers or GSC intelligence tools.
• Resell or redistribute output from our free tools as a standalone commercial software product without prior written consent.

We reserve the right to modify, rate-limit, or discontinue any free calculator or tool on the Site at any time without notice.

4. Client Responsibilities & Site Access

If you engage Bluejaypro for professional SEO or web services, the success of your campaign requires timely cooperation. You agree to:

• Provide Accurate Information: Supply accurate business information, Name/Address/Phone (NAP) details, and service descriptions, and ensure you hold all necessary licenses for your industry (e.g., state bar compliance for attorneys, medical/dental compliance for dentists, contractor licenses for HVAC pros).
• Grant Necessary Access: Provide administrative or delegated access to your website CMS, hosting, Google Search Console, Google Analytics, and Google Business Profile as needed to implement optimizations.
• Review Approvals: Review and approve proposed content or site changes within a reasonable timeframe.
• Avoid Conflicting Modifications: Notify Bluejaypro before making major structural changes to your website (such as changing URLs, switching themes, blocking crawlers, or hiring simultaneous SEO providers) that could negatively impact your rankings.

5. Fees, Billing, and Cancellation

For paid agency Services:

• Payment Terms: Fees are billed in advance on a monthly retainer or project basis as specified in your SOW or invoice.
• Late Payments: Late payments may result in a temporary pause of active SEO work until the account is brought current.
• Refund Policy: Because SEO services require upfront labor, research, content creation, and technical implementation, fees paid for completed or in-progress monthly retainer periods and one-time audits are non-refundable unless otherwise stated in your signed SOW.
• Cancellation: Either party may cancel ongoing monthly Services in accordance with the notice period specified in your SOW (or with 30 days’ written notice if no notice period is specified).

6. Intellectual Property Rights

A. Bluejaypro Intellectual Property

All content on bluejaypro.com—including our brand assets, logos, website design, calculator algorithms, custom AI SEO software, proprietary regex templates, methodologies, and text—is owned by Bluejaypro and protected by United States and international copyright, trademark, and intellectual property laws.

B. Client Deliverables

Upon your payment in full of all applicable fees, you own the final custom content, on-page optimizations, and website copy created specifically for your domain during your engagement. Bluejaypro retains ownership of its underlying internal tools, scripts, templates, and general SEO know-how.

C. Portfolio Rights

Unless otherwise agreed in writing (such as under a Non-Disclosure Agreement), you grant Bluejaypro the right to reference your business name, logo, and anonymized or public performance metrics (e.g., traffic growth percentages, ranking improvements) in our portfolio and case studies.

7. SMS & Electronic Communications

By submitting your phone number or email on our Site, you consent to receive communications from Bluejaypro electronically, including via email, phone calls, and SMS text messages regarding your inquiry, appointment, or account.

• Opt-Out: You may opt out of SMS messages at any time by replying “STOP”, or request assistance by replying “HELP”.
• Carrier Liability: Wireless carriers are not liable for delayed or undelivered messages. Standard message and data rates may apply.

8. Disclaimer of Warranties

THE SITE, CALCULATORS, AI SEO TOOLS, AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. BLUEJAYPRO DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR IMMUNE FROM THIRD-PARTY SEARCH ENGINE PENALTIES CAUSED BY PRIOR SEO PRACTICES OR ALGORITHM CHANGES.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW, IN NO EVENT SHALL BLUEJAYPRO, ITS FOUNDERS, EMPLOYEES, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR DROP IN SEARCH ENGINE RANKINGS) ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES.

OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO BLUEJAYPRO IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM (OR $100 USD IF YOU HAVE ONLY USED OUR FREE SITE AND TOOLS).

10. Indemnification

You agree to indemnify, defend, and hold harmless Bluejaypro and its team from and against any third-party claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of: (a) materials, photos, or claims you provide for publication on your website; (b) your violation of industry-specific advertising regulations (e.g., legal, dental, or contractor board rules); or (c) your breach of these Terms.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Sacramento County, California, and the parties hereby consent to personal jurisdiction and venue therein.

12. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will become effective immediately upon posting to this page with an updated “Last Updated” date. Your continued use of the Site or Services following the posting of changes constitutes your acceptance of such changes.
